Breckenridge Short-Term Rental Rules: 2026 Checklist

Breckenridge Short-Term Rental Rules: 2026 Checklist

If you own a rental property in Breckenridge, the regulatory landscape heading into winter 2026 is more layered than it was even a few years ago. Understanding the current breckenridge short term rental rules before ski season opens is not just good practice, in some zones, the rules may affect whether you can legally rent at all.

The Accommodation Unit License: Start Here

Breckenridge defines a short-term rental as any rental of less than 30 consecutive days. Before you advertise your property anywhere, on any platform, you are required to hold a valid Accommodation Unit License from the Town. That license number must appear in all advertising, in the specific format: "Breckenridge Business License No. [your number]." The Town's FAQ is the authoritative source for current application requirements and renewal procedures.

You will also need a separate Town Business and Occupational License (BOLT) annually. These are two distinct requirements, and missing either one puts you out of compliance before a single guest checks in.

One Detail Buyers Often Miss

The Accommodation Unit License is non-transferable on sale. When a property changes hands, the license ends. The new buyer must apply for their own license after closing, under current rules, which means they are subject to whatever zone availability exists at that time. This is a material fact in any Breckenridge real estate transaction involving a rental property.

The Four-Zone System and What It Means for Availability

Ordinances passed in 2021 and 2022 capped the total number of STR licenses in Breckenridge at 2,200, distributed across four zones. A legal challenge from property owners was dismissed by federal courts in 2024, so the framework is settled law for now.

As of data reported to Town Council in February 2026, here is where each zone stands:

  • Resort Zone: Cap of 1,816 licenses; 1,719 held as of December 2025. Open for new applications.
  • Zone 1 (Tourism Zone): Cap of 1,680; 1,225 held as of December 2025. Open, with approximately 459 licenses available as of July 2026.
  • Zone 2 (Downtown Core): Cap of 130; at capacity as of December 2025. Waitlisted.
  • Zone 3 (Residential): Cap of 390; 1,058 held as of December 2025, well above the cap due to grandfathered licenses. Waitlisted, with estimated wait times that may extend as long as 20 years based on current attrition rates.

If your property sits in a zone that is open, apply before winter demand peaks. If your property is in Zone 2 or Zone 3 and you do not already hold a license, you should verify your status with the Town directly before making any marketing or management commitments.

Annual Fees: What You Should Budget

The annual licensing cost in Breckenridge has two main components. The Accommodation Unit License fee runs from $75 for a studio up to $175 for a property with four or more bedrooms. On top of that, an annual regulatory fee applies: $756 per studio or bedroom, with no bedroom cap. The Town's own example puts the total annual cost for a four-bedroom property at $3,199, inclusive of the license fee.

There is one exemption worth knowing. If the property is your primary residence and you rent it for no more than 21 days per year, the regulatory fee does not apply. According to town staff data reported in early 2026, 54 active licenses qualified for this exemption in 2025. If you think you may qualify, confirm the current criteria with the Town of Breckenridge Finance Department before assuming the fee is waived.

Tax Obligations for Short-Term Rentals

Breckenridge short-term rental revenue is subject to a combined lodging tax rate drawn from several jurisdictions: Colorado state, the Town of Breckenridge, the Town's accommodation tax, the Mountain Housing Authority, and Summit County. Verify the current combined rate directly with the Town's Finance Department, as rates can change.

For bookings made through Airbnb or VRBO, both platforms have agreements with the Town to collect and remit applicable taxes on your behalf, Airbnb since October 2019 and VRBO since January 2020. If you take any direct bookings outside those platforms, the tax collection obligation is yours. This is an easy compliance gap to miss if you manage a mix of channel and direct reservations.

The Responsible Agent Requirement

Every Breckenridge STR license holder must designate a Responsible Agent: a person or company reachable 24 hours a day, 7 days a week, who must respond to any complaint about the property within a defined window. For owners who are not local, this is a meaningful operational commitment. Many owners address this through professional Breckenridge property management, where the management company formally serves as the Responsible Agent.

If you are self-managing from out of state, think carefully about whether you can genuinely fulfill that requirement at 2 a.m. on a powder night in January.

Frequently Asked Questions

Do I need a license before I advertise, or just before I rent?

You need a valid Accommodation Unit License before advertising your property for rent, not just before the first booking. The Town's rules make the license a prerequisite for any public listing, and your license number must appear in every advertisement.

What happens to my STR license if I sell the property?

The license does not transfer to the buyer. A sale terminates the existing license, and the buyer must apply for a new one under current zone rules. Depending on which zone the property is in, a new license may not be available at all.

If Airbnb collects my taxes, do I have anything left to do?

For bookings made through Airbnb or VRBO, those platforms remit applicable Town taxes. However, if you accept any direct bookings, you are responsible for collecting and remitting taxes on those reservations yourself. It is worth auditing how all your reservations are booked before winter season.
